align=\"justify\">Under Republic 9048, as amended by Republic Act 10172, Filipinos abroad may file a petition before the Philippine Embassy in Canberra and Consulate General to correct a clerical or typographical error in an entry in the Civil Register without need of a judicial order.<br \/><br \/>RA 9048, as amended by R.A. 10172, allows the correction of clerical or typographical errors in any entry in civil registry documents.<br \/><br \/>A clerical or typographical error refers to an obvious mistake committed in clerical work, either in writing, copying, transcribing, or typing an entry in the civil register that is harmless and innocuous, such as the following:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-db640b7 elementor-widget elementor-widget-text-editor\" data-id=\"db640b7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ol><li>A misspelled name or misspelled place of birth and the like, and can be corrected or changed only by reference to other existing record or records<\/li><li>Day and\/or month of birth<\/li><li>Gender\/sex (provided that this correction is not a result of a sex-reassignment)<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e681875 elementor-widget elementor-widget-heading\" data-id=\"e681875\" elementor-size-default\">WHO MAY FILE THE PETITION?<\/h5>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c186af9 elementor-widget elementor-widget-text-editor\" data-id=\"c186af9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The petition may be filed by a person of legal age who must have a direct and personal interest in the correction of the error in the civil register, such as the:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3d4bd47 elementor-widget elementor-widget-text-editor\" data-id=\"3d4bd47\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>Owner of the record that contains the error to be corrected or first name to be changed<\/li><li>Owner\u2019s spouse, children, parents, brothers, sisters, grandparents, guardian, or any other person duly authorized by law or by the owner of the document sought to be corrected.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-073c78b elementor-widget elementor-widget-text-editor\" data-id=\"073c78b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>A person is considered of legal age when he is eighteen years old and above. Thus, a minor (less than eighteen years old) cannot by himself file a petition.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bed7cb0 elementor-widget elementor-widget-heading\" data-id=\"bed7cb0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">WHERE SHOULD THE PETITION BE FILED?<\/h5>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-023e14c elementor-widget elementor-widget-text-editor\" data-id=\"023e14c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The general rule is that petition shall be filed with the Local Civil Registry Office (LCRO) where the record containing the clerical error to be corrected is kept. Included in this general rule is the case of the Office of the Clerk of Shari\u2019a Court where records of divorces, revocations of divorces, conversions to Islam are kept and where some Muslim marriages are registered.<br \/><br \/><b>However, in case the petitioner is a migrant within or outside the Philippines, meaning his present residence or domicile is different from where his civil registry record or records are registered, he may file the petition in the nearest LCRO in his area or Philippine Embassy\/Consulate General if abroad.<\/b>\u00a0His petition will be treated as a migrant petition.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-07a95fb elementor-widget elementor-widget-heading\" data-id=\"07a95fb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">HOW MUCH IS THE FEE IN FILING A PETITION?<\/h5>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-35cc71b elementor-widget elementor-widget-text-editor\" data-id=\"35cc71b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>If the petitioner will file in the Philippines, the C\/MCR and the District\/Circuit Registrar (D\/CR) are authorized to collect from every petitioner\u00a0<b>One Thousand Pesos (P1,000.00)<\/b>\u00a0for the correction of clerical error.<br \/><br \/>If the petitioner is living abroad and will file a petition at the Philippine Embassy\/Consulate General, the fee is US$50.00 or\u00a0<b>A$90.00<\/b>\u00a0for the correction of clerical or typographical error, US$150 or\u00a0<b>A$270.00<\/b>\u00a0for the change of first name, plus\u00a0<b>A$45<\/b>\u00a0for the notarial fee of the Affidavit.<br \/><br \/>A migrant petitioner shall pay an additional service fee of Five Hundred Pesos (P500.00) for the correction of clerical or typographical error to the Petition Receiving Civil Registrar (PRCR). This service fee shall accrue to the local treasury of the PRCR. The petitioner will be contacted by the LCRO for details of the payment.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-53eea21 elementor-widget elementor-widget-heading\" data-id=\"53eea21\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">REQUIREMENTS TO FILE A PETITION FOR CORRECTION OF CLERICAL OR TYPOGRAPHICAL ERROR<\/h5>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-17b3e42 elementor-widget elementor-widget-text-editor\" data-id=\"17b3e42\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><b>Petition is in the prescribed form of an\u00a0AFFIDAVIT<\/b>\u00a0that:<\/p><ol><li>Must be subscribed and sworn to before any person authorized by law to administer oath.<\/li><li>Set forth facts necessary to establish the merits of the petition.<\/li><li>Show affirmatively that the petitioner is competent to testify to the matters stated.<\/li><li>State the particular erroneous entry or entries sought to be corrected and the correction to be made.<\/li><\/ol><p><br \/><b>Petition must be supported with the following documents:<\/b><\/p><ol><li>A certified true machine copy of the certificate or of the page of the registry book containing the entry or entries sought to be corrected or changed;<\/li><li>At least two (2) public or private documents showing the correct entry or entries upon which the correction or change shall be based;<\/li><li>Notice or certification of posting;<\/li><li>Other documents which the petitioner or the Consul General may consider relevant and necessary for the approval of the petition.<\/li><\/ol><p><br \/><b>In case of correction of DAY AND\/OR MONTH in the date of birth or SEX of a person, the petition shall be supported with the following documents:<\/b><\/p><ol><li>Earliest school record or earliest school documents;<\/li><li>Medical records;<\/li><li>Baptismal certificate and other documents issued by religious authorities;<\/li><li>A clearance or a certification that the owner of the document has no pending administrative, civil or criminal case, or no criminal record, which shall be obtained from the following:<ul><li>Employer, if employed;<\/li><li>National Bureau of Investigation; and<\/li><li>Philippine National Police.<\/li><\/ul><\/li><\/ol><p><b>In case of correction of sex, the petition shall be further supported with:<\/b><\/p><ol><li>A medical certification issued by an accredited government physician that the petitioner has not undergone sex change or sex transplant.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-30910ed ha-has-bg-overlay elementor-widget elementor-widget-text-editor\" data-id=\"30910ed\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\tFOR CIVIL REGISTY REPORTED AT THE PHILIPPINE CONSULATE GENERAL IN MELBOURNE\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-543f72b elementor-widget elementor-widget-text-editor\" data-id=\"543f72b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><b>STEP 1<\/b><br \/>Book an appointment by emailing the Civil Registry Section (CRS) at\u00a0<span id=\"cloak598cafe25dbb54d9562e00240555017b\"><a href=\"mailto:melbourne.pcg@dfa.gov.ph\">melbourne.pcg@dfa.gov.ph<\/a><\/span><br \/><br \/><b>STEP 2<\/b><br \/>On day of the appointment, submit Petition &amp; all the required documents stated above and provide necessary information during interview<br \/><br \/><b>STEP 3<\/b><br \/>Pay the corresponding fees at the Consulate\u2019s Cashier.<br \/><br \/><b>STEP 4<\/b><br \/>Return to CRS and submit the Official Receipt. CRS staff to inform petitioner on the date of release in conformity with the required 10-day posting and 5-day decision of the Consul General.<br \/><br \/><b>STEP 5<\/b><br \/>Posting of Petition at the Philippine Consulate\u2019s bulletin board for 10 consecutive days.<br \/><br \/><b>STEP 6<\/b><br \/>The Consulate issues the Certificate of Posting.<br \/><br \/><b>STEP 7<\/b><br \/>After 5 days, the Consul General acts on the Petition.<br \/><br \/><b>STEP 8<\/b><br \/>The Consulate sends the approved petition to the DFA Manila via diplomatic pouch scheduled the following month.<br \/><br \/><b>STEP 9<\/b><br \/>DFA Manila sends the approved petition to the Office of the Civil Registrar General (OCRG) in Manila.<br \/><br \/><b>STEP 10<\/b><br \/>OCRG acts on the approved petition.<br \/><br \/><b>STEP 11<\/b><br \/>OCRG Manila forwards decision to DFA Manila.<br \/><br \/><b>STEP 12<\/b><br \/>DFA Manila forwards OCRG\u2019s decision to the Philippine Consulate.<br \/><br \/><b>STEP 13<\/b><br \/>The Consulate issues the Certificate of Finality. CRS Staff informs the client of the decision of the OCRG.<br \/><br \/><b>STEP 14.a<\/b><br \/>(If petition is affirmed by OCRG) the Consulate sends to DFA Manila the Certificate of Finality, and certified true copies (CTC) of the un-annotated civil registry document, CTC of the annotated civil registry document, CTC of the Petition, together with the covering despatch.<br \/><br \/><b>STEP 14.b<\/b><br \/>(If petition is impugned by OCRG) the Consulate, within 15 days upon receipt of the impugned petition, files a motion for reconsideration to OCRG and sends said motion to the OCRG through DFA Manila.<br \/><br \/><b>STEP 15<\/b><br \/>DFA Manila transmits to OCRG the Certificate of Finality, and CTC of the un-annotated civil registry document, annotated civil registry document, the Petition together with the endorsement letter (if petition has been affirmed) OR the Motion for Reconsideration (if the petition has been impugned).<br \/><br \/><b>STEP 16<\/b><br \/>Petitioner may request at PSA Manila an authenticated copy of the corrected or annotated Civil Registry document paper three days after DFA Manila has forwarded to OCRG the Certificate of Finality, other CTC of petition and supporting documents, including the endorsement letter.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9014ccc ha-has-bg-overlay elementor-widget elementor-widget-text-editor\" data-id=\"9014ccc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\tFOR MIGRANT PETITION FOR CORRECTION OF CLERICAL OR TYPOGRAPHICAL ERROR\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a1f9e20 elementor-widget elementor-widget-text-editor\" data-id=\"a1f9e20\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><b>STEP 1 &#8211; 6<\/b><br \/>Follow Step 1 \u2013 6 procedure for filing of petition for correction of civil registry documents registered at the Philippine Consulate<\/p><p><b>STEP 7<\/b><br \/>After 5 days, the Consul General acts on the Petition by forwarding said petition to the Local Civil Registrar (LCR) where the record of civil registry document was registered.<\/p><p><b>STEP 8<\/b><br \/>The Consulate sends the petition to DFA Manila via diplomatic pouch scheduled the following month.<\/p><p><b>STEP 9<\/b><br \/>DFA Manila forwards the petition to the Local Civil Registrar (LCR) where the record of civil registry document was registered.<\/p><p><b>STEP 10<\/b><br \/>The LCR will contact and ask the Petitioner to pay for the additional service fee.<\/p><p><b>STEP 11<\/b><br \/>Petitioner or his representative proceeds to LCR, pay the appropriate fee and submit the Official Receipt. LCR to inform petitioner or his representative on the date of release in conformity with the required 10-day posting and 5-day decision of the LCR.<\/p><p><b>STEP 12<\/b><br \/>Upon receipt of payment, LCR prepares Notice of Posting.<\/p><p><b>STEP 13<\/b><br \/>LCR posts the Petition at a conspicuous place for 10 consecutive days.<\/p><p><b>STEP 14<\/b><br \/>DFA Manila sends the approved petition to the Office of the Civil Registrar General (OCRG) in Manila.<\/p><p><b>STEP 15<\/b><br \/>OCRG acts on the approved petition.<\/p><p><b>STEP 16<\/b><br \/>OCRG Manila forwards decision to DFA Manila.<\/p><p><b>STEP 17<\/b><br \/>LCR posts the Petition at a conspicuous place for 10 consecutive days.<\/p><p><b>STEP 18<\/b><br \/>LCR issues Certificate of Posting<\/p><p><b>STEP 19<\/b><br \/>LCR acts on the petition after 5 days. LCR informs petitioner or his representative that the petition has been approved.<\/p><p><b>STEP 20<\/b><br \/>Petitioner or his representative proceed to LCR and get copy of the approved petition at LCR level on the appointed date.<\/p><p><b>STEP 21<\/b><br \/>LCR mails the approved petition to OCRG Manila.<\/p><p><b>STEP 22<\/b><br \/>OCRG acts on the approved petition.<\/p><p><b>STEP 23<\/b><br \/>OCRG Manila forwards decision to LCR.<\/p><p><b>STEP 24<\/b><br \/>LCR issues the Certificate of Finality.<\/p><p><b>STEP 25.a<\/b><br \/>(If petition is affirmed by OCRG) LCR mails to OCRG Manila the Certificate of Finality, record sheet, annotated Civil Registry Document, and endorsement letter.<\/p><p><b>STEP 25.b<\/b><br \/>(If petition is impugned by OCRG) The LCR, within 15 days upon receipt of the impugned petition, files a motion for reconsideration to OCRG and sends said motion to the OCRG.<\/p><p><b>STEP 26<\/b><br \/>Petitioner may request at PSA\/NSO Manila an authenticated
